Safe Driver ProgramPursuant to Indiana Code 34-28-5-1 the Shelby County Prosecutorís Office has a pre-trial deferral program for safe drivers at least 18 years of age that are cited for certain offenses. Successful completion of the pre-trial deferral program will involve in your ticket being dismissed and no conviction on your driving record. You should have received the form for the Safe Driver Program from the Officer that wrote you the ticket. If you are younger than 18 years of age, you are not eligible to participate in this program.

 

If you are charged with any offense other than speeding, you may participate in the Safe Driver program on a case-by-case basis. You need to contact us to see if you qualify. This voluntary program allows motorists who have a good driving record to maintain it. In addition, the money collected will help pay expenses for the Prosecutor's Office and other local law enforcement agencies. The Prosecutor alone determines if you have met the requirements of the programs and the Prosecutor alone determines if you have violated the programs. Furthermore, the Prosecutor reserves the right to deny either program to any person for any reason.

 

If you have already paid your ticket, we cannot accept you on this program.

 

Generally, you do not qualify for the safe driver program if you have

  • have a commercial driver’s license (CDL)

  • have taken defensive driving within the past 2 years; or

  • have a pending felony, misdemeanor, or infraction traffic case;

You will be required to complete an affidavit admitting that your were speeding and that you do not have any convictions or defensive driving courses within the past two (2) years and that you do not have any pending felony, misdemeanor, or infraction traffic case.

 

You will also be required to provide the following items:

  • Your original citation ticket; and,

  • A copy of your driverís license; and,

  • A copy of your driving record if you do not hold an Indiana Driverís License; and,

  • A certified check or money order (no personal checks) in the amount of $151.00 payable to: Shelby County Clerk.

Everything must be received at least 10 days prior to your court date.

 

If you fail to complete the procedures listed above completely and in a timely manner, you must either appear in court or pay your fine and court costs as indicated on your ticket. If you fail to appear in court as instructed, a warrant will be issued for your arrest. It is your responsibility to make sure that the program is completed. If you want to be sure we received the items, you should consider delivering them personally or send them registered mail, return receipt requested.

 

List of Possible Eligible Offenses for this Program: (determined by Prosecutorís Office on a case by case basis)

  • Disregarding traffic control device that did not involve in a crash or accident

  • Disregarding red light that did not involve in a crash or accident

  • Disregarding stop sign that did not involve in a crash or accident

  • Disregarding auto signal that did not involve in a crash or accident

  • Drivers license not in possession

  • Driving across divided highway that did not involve in a crash or accident

  • Expired drivers license

  • Expired registration

  • Expired license plate

  • Fail to carry registration

  • Fail to use or dim headlights

  • Failure to yield that did not involve in a crash or accident

  •  False or fictitious registration

  • Following too close

  • Improper registration

  • Improper display of license plate

  • Improper start from parked position that did not involve in a crash or accident

  • Improper turn that did not involve in a crash or accident

  • Improper lane usage that did not involve in a crash or accident

  • Improper passing that did not involve in a crash or accident

  • Improper backing that did not involve in a crash or accident

  • Left of center that did not involve in a crash or accident

  • No or improper windshield wipers

  • No or improper brake lights

  • No or improper license plate light

  • No or improper rear view mirror

  • No or improper tail lights

  • No or improper head lights

  • No or improper brakes

  • No or improper turn signals

  • No or improper tires

  • No or improper mufflers

  • No or improper bumper

  • Passing on double yellow line

  • Failure to Yield right-of-way to marching band procession that does not involve injury (See Indiana Code ß 9-21-14-3).

  •  Speeding 1-24 miles over speed limit

  • Tinted windows that did not involve in a crash or accident

  • Illegal U-turn that did not involve in a crash or accident

  • Wrong way on one way that did not involve in a crash or accident
